Case Summary
Case Title: M. P. Commodities Pvt. Ltd. & Anr. v. State of Gujarat & Anr.
Court: High Court of Gujarat at Ahmedabad
Petition No.: R/Special Civil Application No. 18169 of 2023
Date of Judgement: 11.12.2024
Category of Dispute: Validity of SCN (Show Cause Notice) and De-novo proceedings
Relevant Sections: Articles 226 & 227 of the Constitution; CGST Act provisions on SCN – Form DRC-01, DRC-01A, and adjudication under Section 73/74; Rule 142 of CGST Rules
Facts (Paras 2–3)
The petitioner challenged fresh notices in Form DRC-01 (29.09.2023) and DRC-01A (27.09.2023) for July 2017–March 2018. Earlier, in SCA No. 3796/2022, the Court had quashed assessment orders dated 18.12.2021 and 27.12.2021 (DRC-07) for being non-speaking and directed the authority to rehear and pass a reasoned order within three months. Instead of continuing proceedings under the original SCNs, the authority issued fresh notices, which the petitioner claimed was impermissible.
Questions before Court
-
Whether fresh SCNs could be issued when earlier SCNs were still pending pursuant to remand by the Court?
-
Whether the department’s understanding that the proceedings had to be started de-novo was legally sustainable?
Observations (Paras 4–8)
-
The Court noted the petitioner’s grievance that fresh notices were not tenable since earlier ones were alive.
-
The State argued that once the DRC-07 orders were quashed, proceedings had to continue de-novo, necessitating fresh SCNs.
-
The Court clarified that its earlier order (09.03.2022) only required continuation of proceedings with reasoned adjudication; the respondent’s belief of complete annulment was misplaced.
-
However, the petitioner suffered no prejudice, except that the exercise was delayed.
-
To balance equity, the Court held that instead of reviving earlier SCNs, the petitioner may reply to the fresh SCNs, which would be adjudicated within 12 weeks.
Judgement (Paras 8–11)
-
Court declined to quash fresh SCNs.
-
Directed petitioner to file reply within six weeks.
-
Ordered adjudicating authority to pass a fresh reasoned order within 12 weeks in line with earlier directions.
-
Clarified that earlier SCNs no longer survive; proceedings to continue only under fresh SCNs.
-
Interim relief against issuance of advisory or summons to petitioner’s buyers was continued till disposal of proceedings.
-
Petition disposed.
Table – Cases Referred
| Case | Court’s observation / outcome |
|---|---|
| M. P. Commodities Pvt. Ltd. v. State of Gujarat (SCA No. 3796/2022, order dated 09.03.2022) | Earlier DRC-07 orders quashed as non-speaking; matter remanded for fresh hearing with reasoned order; exercise to be completed within 3 months. |
Between Fine Lines
For taxpayers, this ruling clarifies that once an adjudication order is quashed and matter is remanded, the department may issue fresh SCNs under a de-novo understanding, and courts may not interfere if no prejudice is caused. Businesses should, however, be mindful of timelines and continue to engage with fresh notices to avoid ex parte orders. The relief against harassment of buyers through summons reinforces the principle that adjudication should focus on the assessee, not third parties.
