Case Summary: M/s. Srinivas Pradhan v. Joint Commissioner of CT & GST, Ganjam & Another
Court: High Court of Orissa, Cuttack
Petition No.: W.P.(C) No. 30698 of 2024
Category: Pre-deposit requirement for appeal – Stay of demand
Date of Judgment: 17 December 2024
Relevant Sections: Section 112(8) of the CGST Act, 2017; Section 107(6) (Appeal to Appellate Authority); Rule 108 of the CGST Rules, 2017
Facts (Para 1–3):
The petitioner, M/s. Srinivas Pradhan, challenged the First Appellate Authority’s order dated 27 September 2024. The petitioner intended to file a second appeal before the GST Appellate Tribunal, but since the Tribunal had not yet been constituted, he approached the High Court seeking relief. Relying on the earlier judgment of the Orissa High Court in M/s. Maa Tarini Traders v. State of Odisha (WP(C) No. 42015 of 2023, order dated 16 February 2024), it was submitted that taxpayers were permitted to file writ petitions and obtain stay of demand upon depositing prescribed percentages of disputed tax. Initially, this required a 10% deposit at the first appeal stage and an additional 20% for stay of the appellate order.
However, the petitioner argued that the Central Government, vide Notification dated 16 August 2024, had reduced the additional pre-deposit requirement to 10%, and the State Government of Odisha followed suit through Notification dated 29 October 2024. Hence, the petitioner requested that the earlier directions be modified to align with the new deposit structure.
Questions of Law:
Whether, in light of the revised Central and State notifications, the petitioner is entitled to stay of the impugned appellate order upon depositing only 10% of the remaining disputed tax instead of the earlier 20%.
Observations (Para 4–5):
The Bench comprising Justice Arindam Sinha and Justice M.S. Sahoo noted that both Central and State authorities had indeed revised the pre-deposit requirement to 10% for securing a stay of the disputed tax demand during pendency of appeal before the yet-to-be-constituted Tribunal. The Court accepted the petitioner’s contention, holding that the previous direction requiring a 20% deposit must stand modified accordingly.
Judgment (Para 6):
The writ petition was disposed of in line with the precedent of Maa Tarini Traders (supra), with the modification that the petitioner need deposit only 10% of the remaining disputed tax to obtain stay on the impugned appellate order.

Between Fine Lines:
