Case Summary: Radha Madhav Automobiles Pvt. Ltd. v. State of Andhra Pradesh & Others
Court: High Court of Andhra Pradesh, Amaravati
Petition No.: W.P. No. 31359 of 2024
Date of Judgment: 31 December 2024
Category: GST Assessment – Validity of Unsigned Orders / Absence of DIN
Relevant Provisions: Sections 160 & 169 of the CGST Act, 2017; CBIC Circular No. 128/47/2019-GST dated 23.12.2019
Dispute Category: Assessment Order Invalidity

Facts of the Case (Para 1–3)

Radha Madhav Automobiles Pvt. Ltd. was issued assessment orders under Form GST DRC-07 dated 12.01.2022 and Form GST DRC-08 dated 18.01.2022 for the period 2017–2022 by the Assistant Commissioner (ST). The petitioner challenged these orders, contending that they lacked both the signature of the assessing officer and the Document Identification Number (DIN)—key elements ensuring authenticity and traceability under GST administration.

The State admitted during proceedings that indeed, the orders bore no signature and no DIN, confirming procedural lapses in issuance.

Questions Before the Court

  1. Whether an unsigned GST assessment order is valid in law.

  2. Whether absence of a DIN number renders a GST order void.

Court’s Observations (Para 4–8)

The Division Bench drew upon several precedents:

  • A.V. Bhanoji Row v. Asst. Commissioner (ST), W.P. No. 2830/2023 (14.02.2023): held that absence of a signature renders an order invalid; Sections 160 and 169 cannot cure such a defect.

  • M/s. SRK Enterprises v. Asst. Commissioner (W.P. No. 29397/2023, 10.11.2023) and M/s. SRS Traders v. Asst. Commissioner (W.P. No. 5238/2024, 19.03.2024): reaffirmed the same view.

  • Pradeep Goyal v. Union of India (2022 (63) G.S.T.L. 286 SC): the Supreme Court held that omission of DIN makes an order non-est.

  • Cluster Enterprises v. DAC (ST)-2, Kadapa (2024 (88) G.S.T.L. 179 AP) and Sai Manikanta Electrical Contractors v. DC, Visakhapatnam (2024 (88) G.S.T.L. 303 AP): reiterated that the CBIC circular mandates DIN inclusion for validity.

Based on these authorities and the CBIC circular dated 23.12.2019, the Court observed that both signature and DIN are essential for an assessment order’s validity, failing which the order is non-est in law.

Judgment (Para 9)

The High Court allowed the writ petition, quashing the impugned assessment orders in Forms GST DRC-07 and DRC-08 as invalid for lacking signature and DIN.
However, liberty was granted to the assessing authority to re-initiate fresh assessment after issuing proper notice and duly signed orders containing valid DIN.
The Court also clarified that the period between the impugned order and this judgment shall be excluded for limitation purposes. No costs were awarded.

Between Fine Lines (Practical Takeaway)

This judgment reinforces administrative discipline under GST. Every assessment order must bear a legible signature and DIN to establish authenticity and accountability. Unsigned or DIN-less GST orders are void ab initio, and taxpayers may challenge them even at the writ stage. Departments must ensure strict adherence to procedural integrity before issuance of orders to prevent quashing.
