Case Details

Case Title: Rakesh Kumar v. State Tax Officer
Court: High Court of Uttarakhand, Nainital
Petition No.: Writ Petition (M/S) No. 3283 of 2024
Judgment Date: 06 December 2024
Category of Dispute: GST Registration Cancellation – Revocation of registration
Relevant Section(s): Section 29(2) and Section 30(2) of the CGST Act, 2017

Facts of the Case (Paras 2–4)

The petitioner, a proprietorship firm operating as M/s Durga Gift and Crockery Centre, was registered under the CGST Act, 2017. The GST registration was cancelled by the State Tax Officer through an order dated 20.12.2022, citing continuous non-filing of returns for six months. The petitioner sought quashing of the cancellation order and show cause notice, along with a direction for revival of GST registration.

Questions in Dispute

Whether the cancellation of GST registration for non-filing of returns can be set aside, if the taxpayer expresses readiness to file pending returns and pay outstanding dues, interest, and penalty under the CGST Act.

Observations of the Court (Paras 5–9)

The Court noted that the petitioner admitted to default but expressed willingness to make good the compliance by filing all pending GST returns and paying applicable tax, interest, and penalty. Counsel for the petitioner also referred to an identical case (WPMS No. 2285 of 2024), where relief had been granted. The State did not oppose this submission.

The Court observed that in light of Section 30(2) of the CGST Act, an application for revocation of cancellation can be made. The matter was therefore squarely covered by earlier precedent.

Judgment / Verdict (Paras 8–10)

The High Court disposed of the writ petition with the following directions:

  • The petitioner is permitted to apply for revocation of cancellation under Section 30(2) of the CGST Act within two weeks.

  • The petitioner must simultaneously file all pending GST returns and deposit outstanding dues of tax, interest, and penalty.

  • The Competent Authority is directed to consider the application and pass an order within four weeks of filing.

Accordingly, the cancellation was not outright quashed but conditional liberty was granted for revocation upon compliance.

Table of Referred Cases

Case Citation Outcome / Relevance
Unnamed case (WPMS No. 2285 of 2024, Uttarakhand HC) – Court allowed revocation of GST registration subject to filing pending returns and payment of dues; applied by analogy in the present case.

Between Fine Lines

This judgment reaffirms that GST registration cancellations for non-filing of returns are not irreversible. If taxpayers promptly file pending returns and clear dues, courts are inclined to grant an opportunity for revocation under Section 30(2) of the CGST Act. Businesses should act swiftly, as courts impose strict timelines for compliance and application.
