Case Title: Gew Machines v. State Tax Officer, Sundargarh Circle
Court: High Court of Orissa, Cuttack
Petition No.: W.P.(C) No. 9531 of 2025
Category of Dispute: Revocation of GST Registration / Delay Condonation
Date of Judgment: 19 June 2025
Relevant Sections: Section 29 & Section 30 of the CGST Act, 2017; Rule 23 of the CGST/OGST Rules, 2017
Facts (Para 2–3)
The petitioner, Gew Machines, challenged the show cause notice dated 6 June 2023 and the consequent cancellation order dated 7 July 2023 issued under the CGST Act 2017. The petitioner contended that it was ready and willing to pay the tax, interest, late fee, and penalty necessary for acceptance of its returns. Relying on a prior judgment in M/s Mohanty Enterprises v. Commissioner CT & GST, Odisha (W.P.(C) No. 30374 of 2022), counsel submitted that similar relief—condonation of delay and direction for consideration of revocation—had been granted in that case.
Questions before the Court
Whether the delay in invoking the proviso to Rule 23 of the OGST Rules for revocation of GST registration could be condoned in the interest of justice when the taxpayer expresses readiness to pay all statutory dues.
Observations (Para 4)
The Court referred to para 2 of the Mohanty Enterprises order, wherein delay in invoking Rule 23 was condoned, subject to payment of all dues and compliance with necessary formalities. Following that precedent, the Bench found that the petitioner’s case was squarely covered by the same principle and that revenue interests would not be prejudiced if delay were condoned.
Judgment (Para 4–5)
The Court condoned the delay in filing the revocation application under Rule 23 of the CGST/OGST Rules, 2017. It directed the Department to consider the petitioner’s revocation application upon deposit of all taxes, interest, late fees, and penalties, in accordance with law. The writ petition was disposed of with the same directions as in Mohanty Enterprises.
Summary of Cases Referred
| Case Name | Citation | Issue | Verdict |
|---|---|---|---|
| M/s Mohanty Enterprises v. Commissioner CT & GST, Odisha | W.P.(C) No. 30374 of 2022, Orissa HC | Delay in invoking Rule 23 for revocation of GST registration | Delay condoned subject to payment of all dues; revocation application to be processed per law |
Between Fine Lines
The Orissa High Court reaffirmed that where a taxpayer is willing to regularize defaults by paying all dues, the procedural delay in applying for revocation under Rule 23 should not defeat the substantive right of restoration. This reinforces the judiciary’s pro-revenue yet taxpayer-supportive stance, balancing compliance and fairness.
