Case Title: Arun Kumar Puti v. Commissioner of Commercial Taxes and Goods and Services Tax, Odisha & Anr.
Court: High Court of Orissa at Cuttack
Petition No.: W.P. (C) No. 611 of 2025
Date of Judgment: 10 January 2025
Category: Revocation of GST Registration / Condonation of Delay
Relevant Section/Rule: Section 30 of the Odisha GST Act, 2017 and Rule 23 of the OGST Rules, 2017

Facts (Para 1–2):

The petitioner, Arun Kumar Puti, challenged the show-cause notice dated 9 November 2022 and the consequential order dated 12 December 2022 cancelling his GST registration under the Odisha Goods and Services Tax Act, 2017. The petitioner expressed readiness to discharge all outstanding liabilities including tax, interest, late fee and penalty to enable acceptance of his returns. Relying on M/s Mohanty Enterprises v. Commissioner, CT & GST, Odisha (W.P.(C) No. 30374 of 2022, order dated 16 November 2022), he sought identical relief and condonation of delay in filing his revocation application.

Question before the Court:

Whether delay in invoking the proviso to Rule 23 of the OGST Rules for revocation of registration can be condoned in the interest of justice, allowing reconsideration of the taxpayer’s registration cancellation order upon payment of dues.

Court’s Observations (Para 3):

The Bench examined the precedent in M/s Mohanty Enterprises (supra), wherein delay under Rule 23 was condoned and the department was directed to consider the revocation application upon full payment of taxes, interest, late fee, and penalty, along with completion of other formalities. The same principle was found applicable in the present case to ensure fairness and revenue protection.

Judgment (Para 4):

Following the earlier coordinate Bench view, the Court condoned the delay in the petitioner’s application for revocation and directed that, subject to payment of all dues and compliance with formalities, the department shall reconsider the application in accordance with law. The writ petition was accordingly disposed of in the interest of revenue.

Summary of Cases Referred:

Case Name Court Issue Verdict
M/s Mohanty Enterprises v. Commissioner, CT & GST, Odisha (W.P.(C) No. 30374 of 2022) Orissa HC Condonation of delay under Rule 23 of OGST Rules Delay condoned; revocation application to be processed upon full payment of dues

Between Fine Lines:

The judgment reinforces that courts may permit revocation of cancelled GST registrations even beyond prescribed timelines if the taxpayer demonstrates bona fides and willingness to settle all dues. This approach balances revenue interests with equitable justice, allowing genuine taxpayers a second chance to regularize compliance instead of suffering business paralysis due to procedural delays.
