Case Summary: M/s. ATC Telecom Infrastructure Pvt. Ltd. v. State of Odisha & Others
Court: Orissa High Court, Cuttack
Petition No.: W.P.(C) No.12621 of 2024
Date of Judgment: 09 January 2025
Category of Dispute: Recovery / Garnishee Order – Appeal not possible due to non-constitution of Tribunal
Relevant Section: Section 112 of CGST Act (read with Article 226 of the Constitution of India)
Facts (Para 1–2)
M/s. ATC Telecom Infrastructure Pvt. Ltd., Mumbai challenged a garnishee order freezing its bank account issued by the Odisha GST authorities. The petitioner contended that though a statutory appeal remedy exists under Section 112 of the CGST Act, the State GST Appellate Tribunal had not yet been constituted. To seek interim protection, it deposited an additional 10% of the demand (in addition to earlier payment) following the precedent in M/s Maa Tanini Traders v. State of Odisha, W.P.(C) No. 42015 of 2023, decided on 16 February 2024.
Questions Before the Court
Whether, in the absence of a functional GST Appellate Tribunal, the petitioner could claim protection from coercive recovery and seek release of frozen bank accounts after making a 10% pre-deposit.
Observations (Para 3)
The Bench observed that since the Tribunal was not yet operational, the taxpayer could not avail the statutory appellate remedy. Relying on its earlier decision in Maa Tanini Traders (supra), the Court reaffirmed that where such institutional vacuum exists, taxpayers should not be deprived of appeal rights. Therefore, upon depositing 10% of the demand, coercive recovery steps such as garnishee orders must be lifted.
Judgment (Para 3–4)
The Court quashed the impugned garnishee order and directed that the petitioner obtain a certified copy of the judgment and furnish it to its banker for immediate release of the frozen funds. It clarified that the petitioner retains its right to file a statutory appeal once the GST Appellate Tribunal is constituted. The writ petition was accordingly disposed of.

Between Fine Lines
This decision reinforces that, pending constitution of the GST Appellate Tribunal, taxpayers cannot be left remediless. Courts will intervene to prevent coercive recovery where the statutory appellate remedy is unavailable, provided the taxpayer makes the standard 10% pre-deposit. It serves as a crucial relief mechanism for businesses awaiting Tribunal functioning.
