The Supreme Court of India has issued notice to the respondents in the Special Leave Petitions filed by M/s Jorabat Shillong Expressway Limited against the Union of India and others. The petitions arise from orders passed by the High Court of Meghalaya at Shillong in a writ petition and a subsequent review petition.
The matter was listed before a Bench comprising Justice B.V. Nagarathna and Justice R. Mahadevan on 17 July 2026. The petitioner was represented by senior advocates Mr. Arvind P. Datar and Mr. Sujit Ghosh, along with the other appearing counsel.
Background of the Proceedings
The petitioner approached the Supreme Court through Special Leave Petition (Civil) Nos. 23643–23644 of 2026. The petitions arise from the final judgment and order dated 2 June 2026 in W.P.(C) No. 245 of 2024 and the order dated 7 July 2026 in Review Petition No. 6 of 2026, passed by the High Court of Meghalaya at Shillong.
At the present stage, the Supreme Court has not adjudicated upon the merits of the dispute. The order is confined to the issuance of notice in the Special Leave Petitions and on the petitioner’s prayer for interim relief.
Supreme Court’s Order
After hearing the petitioner’s counsel, the Supreme Court directed that notice be issued to the respondents both on the prayer for interim relief and on the Special Leave Petitions.
The notices have been made returnable on 7 August 2026. The Court also permitted the petitioner’s counsel to serve the Union of India through the Central Agency.
The order indicates that the Supreme Court will consider the petitioner’s request for interim protection along with the maintainability and merits of the Special Leave Petitions after the respondents enter appearance.
Why This Order Is Important
The proceedings are significant because the Supreme Court has agreed to examine the challenge arising from the orders of the Meghalaya High Court and has simultaneously issued notice on the request for interim relief. However, the issuance of notice should not be treated as a final determination of the legal issues involved.
